Attempt to re-open $10.1 billion cigarette case rejected

A Madison County Judge has thrown out an attempt to revive a class action lawsuit against cigarette maker Phillip Morris.

Circuit Judge Dennis Ruth decided that plaintiffs attorneys failed to show that new information would likely change the outcome of the original case, which was thrown out by the Illinois Supreme Court.

In 2000, lawyers filed the original case which claimed consumers were duped by the cigarette maker claiming "light" cigarettes were better for their health than regular cigarettes.

After a three-year battle, Judge Nicholas Byron ruled in the favor of plaintiffs and awarded $10.1 billion in damages.

In 2005 the Illinois Supreme Court reversed the decision.
