City Council members unanimously defeated an ordinance Tuesday night calling to de-annex a property previously annexed into the city.
The property in question is the 38 acres of land located on the northwest corner of Sullivan Drive and Frank Scott Parkway. A group known as the Swansea Development Trust requested that the city de-annex the property. City Economic Development Director Mike Malloy said the trust was seeking sewer access from the neighboring Village of Swansea because it was less expensive.
"They're asking that the property be disconnected from Fairview Heights," Malloy said. "So in turn, what we understand, is that Swansea can annex them."
However, eight of the 10 aldermen in attendance Tuesday night voted against the move.
The land was annexed by the city about a year and a half ago. Malloy said 29 acres are slated for multi-family residential development and commercial development is planned for the other 9 acres.
So what happens now?
"That's a good question," Malloy said. "Candidly, it's probably going to end up in court."
Said city director of land use and development Tim Tolliver, "The ball is in their court, now."
In other City Council activity:
* Aldermen authorized the mayor to enter into a purchase agreement on behalf of the city with DMS Contracting Inc. for first phase of the Perrin Road reconstruction project.
* Council members approved the mayor to enter a contract on behalf of the city with Horner & Shifrin Inc. for the design of the new sidewalks on Lincoln Trail.
*Aldermen approved a a resolution for the city to apply for an Open Space land Acquisition and Development Grant for the renovation of the main pavilion area at Moody Park.
