The driver of the ATV that crashed and killed a 17-year-old last year has been charged with reckless homicide and driving under the influence.

James M. Eschmann, 20, was driving an ATV with David Browning in September 2023 on Trout Camp Road near Waterloo. The ATV wrecked, and Browning was ejected from the vehicle.

He was then taken to a hospital, where he later died.

Eschmann was arrested and charged in connection to Browning’s death on Tuesday. The charges state that Eschmann was driving under the influence when the ATV wrecked and killed Browning.

Eschmann was released after a detention hearing on Thursday, and is slated to appear in court on Aug. 1, official documents said.

Since cash-bail ended on Sept. 18, Illinois now holds detention hearings to determine if someone that’s been charged is a threat to the community before they are released.

Eschmann is represented by public defender Justin Kuehn. His office couldn’t be reached by phone, and he was unavailable at his office to comment.
