Can your child legally walk home from school alone in Illinois? What to know
If you live close to your child’s school, there are several factors you may want to consider before deciding whether to let them walk home alone in Illinois.
Illinois state law does not appear to have a specific provision setting a minimum legal age for children to walk to and from school alone, but general state laws on child endangerment and neglect apply, Teri Ross, executive director of Illinois Legal Aid Online, told the News-Democrat in a recent interview.
A portion of Illinois state law on neglected minors says allowing a child to travel to or from school independently by walking, running or biking does not necessarily constitute neglect, although caveats apply.
“A minor shall not be considered neglected for the sole reason that the minor’s parent or other person responsible for the minor’s welfare permits the minor to engage in independent activities unless the minor was permitted to engage in independent activities under circumstances presenting unreasonable risk of harm to the minor’s mental or physical health, safety, or well-being,” the relevant Illinois statute reads, in part.
The law says the term “independent activities” includes traveling to and from school.
What constitutes an ‘unreasonable risk’ for a child?
However, there are several factors to consider when determining whether allowing your child to travel to school alone presents “unreasonable risk.”
When evaluating whether an activity presents unreasonable risk, the law says courts shall consider whether the activity is “accepted as suitable” for children of the same age, maturity level and developmental capacity as the child in question.
The law says the court should consider these factors, among others:
- The child’s age
- The number of children at the location
- The child’s needs, including any physical or mental disabilities or need for ongoing prescribed medical treatment
- The duration of time the child was unsupervised
- The condition and location where the child was unsupervised
- The time of day or night
- Weather conditions
